Agreement to Terms and Conditions
These Terms and Conditions of Use apply to the Alser
web site located at www.alser.co.uk. The Site is the property of Alser (UK) Limited,
(“Alser”). BY USING THE SITE, YOU AGREE TO THESE TERMS OF USE; IF YOU DO NOT AGREE,
DO NOT USE THE SITE.
Alser reserves the right, at its sole discretion, to change,
modify, add or remove portions of these Terms of Use, at anytime. It is your responsibility
to check these Terms of Use periodically for changes. Your continued use of the Site
following the posting of changes will mean that you accept and agree to the changes.
Alser
reserves the right to change or alter products, specification, special offers, and
or any designs without notice at any time. All artwork is the property of Alser.
All our products and items are subject to stock availability.
Content and Pricing
The
materials on the Site with respect to products may be out of date, and Alser makes
no commitment to update the materials on the Site with respect to such products.
Alser
reserves the right to change or alter prices without prior notice.
Only trade accounts
are subject to generous discounts. Prices are in pounds sterling and subject to V.A.T
and delivery.
Alser endeavour to always offer extremely competitive prices. Any equipment
supplied will remain the property of Alser until such time that the outstanding debt
is discharged by payment in full.
Complaints

Accounts,
Passwords and Security
Certain features or services offered on or through the Site
may require you to open an account (including setting up an Alser ID and password).
You are entirely responsible for maintaining the confidentiality of your account
information, including your password, and for any and all activity that occurs under
your account. You agree to notify Alser immediately of any unauthorized use of your
account or password, or any other breach of security. However, you may be held liable
for losses incurred by Alser or any other user of or visitor to the Site due to someone
else using your Alser ID, password or account.
You may not use anyone else’s Alser
ID, password or account at any time without the express permission and consent of
the holder of that Alser ID, password or account. Alser cannot and will not be liable
for any loss or damage arising from your failure to comply with these obligations.
Violation
of These Terms and Conditions
Alser may disclose any information we have about you
(including your identity) if we determine that such disclosure is necessary in connection
with any investigation or complaint regarding your use of the Site, or to identify,
contact or bring legal action against someone who may be causing injury to or interference
with (either intentionally or unintentionally) Alser’s rights or property, or the
rights or property of visitors to or users of the Site, including Alser ’s customers.
Alser reserves the right at all times to disclose any information that it deems necessary
to comply with any applicable law, regulation, legal process or governmental request.
Alser also may disclose your information when it determines that applicable law requires
or permits such disclosure, including exchanging information with other companies
and organizations for fraud protection purposes.
You acknowledge and agree that Alser
may preserve any transmittal or communication by you with Alser through the Site
or any service offered on or through the Site, and may also disclose such data if
required to do so by law or Alser determines that such preservation or disclosure
is reasonably necessary to (1) comply with legal process, (2) enforce these Terms
and Conditions, (3) respond to claims that any such data violates the rights of others,
or (4) protect the rights, property or personal safety of Alser , its employees,
users of or visitors to the Site, and the public.
You agree that Alser may, in its
sole discretion and without prior notice, terminate your access to the Site and/or
block your future access to the Site if we determine that you have violated these
Terms and Conditions or other agreements or guidelines which may be associated with
your use of the Site.
You agree that Alser may, in its sole discretion and without
prior notice, terminate your access to the Site, for cause, which includes (but is
not limited to) (1) requests by law enforcement or other government agencies, (2)

If
an error is discovered in the price of the goods that you have ordered, we will inform
you as soon as possible. In the event that you order an item and the price published
on the Site is incorrect for any reason, we will contact you to let you know the
correct price and ask you whether you still wish us to fulfil your order at this
price. We shall be under no obligation to fulfil an order for a product, which was
advertised at an incorrect price. We shall give you the option of confirming the
order at the correct price or if you so choose, to cancel the order altogether. If
you cancel and have already paid for the goods in the circumstances described in
this clause, we shall refund the full amount in accordance with these Terms.
Method of Delivery
Should you choose to have your goods delivered, Alser will
ensure that they are packed and palletised for hassle free unloading. We will only
entrust your order to select hauliers with whom we have a longstanding relationship.
We
are able to offer special delivery services so you can get your goods either before
10am, before noon, timed delivery or Saturday delivery.
These special delivery services
carry a premium over standard delivery charges. All delivery charges are calculated
by the weight, dimensions and destination of the purchased items.
We shall have no
liability to you for any delay in the delivery of products ordered or any other matters
to the extent that the delay is due to any event outside our reasonable control,
including but not limited to acts of God, war, flood, fire, labour disputes, strikes,
lock-

negligence) for the acts or omissions of telecommunications service providers or
for failures of, or faults in their networks and equipment.
On
the rare occasion that there are shortages on your order, a Alser representative
will be in contact to inform you of; the specific stock lines we are missing, a date
on which the items will be in stock and to confirm you wish to proceed with the order.
Shortages will be couriered to you free of charge as soon as we have them in stock.
Should
you wish to cancel your order, please do so as soon as possible. If the items have
not left the warehouse there will be no charge incurred. Alser regret that if the
order has already been processed, we will ask you to incur the costs of couriering
the items back to our warehouse, wherein there will be a 15% handling charge to restock
the items and complete the necessary administration.
Damages
Alser will not be held
liable for any damaged goods unless signed for “received damaged” upon delivery.
Upon
receipt of goods you are advised to check that no damage has occurred and all quantities
are correct. Failure to do so within 24 hours could jeopardize any subsequent claim.
The

Alser offer all trade customers the option to take out free credit
facilities.

By requesting a credit account, you agree to necessary credit checks being run on
your company, in order for a credit limit to be set for your account. Alser reserve
the right to refuse credit terms, amend or cancel credit terms at any time.
All our
trade accounts are payable 30 days from date of invoice. If credit limits are exceeded
then Alser reserves the right to withhold supply of all subsequent orders until such
time as payment has been made.
Payments
Alser accept payments in the form of cheque,
BACs, or cash. If an account is not in place then orders will be on a pro forma basis
and must be paid in full prior to dispatch.
